Jury finds Samsung infringed some Apple patents, awards Apple $1.05 billion
No, it was not “business as usual.”
It was not even “justice” as usual.
Business as usual favors stodginess and stonewalling. “Justice” as usual is not justice. Today, after 21 hours of deliberation, a nine-person jury awarded Apple over $1 billion after siding with Apple on a majority, but not all, of its patent infringement claims against Samsung. The verdict overwhelming favored Apple, which sought $2.75 billion in damages. Samsung, in its countersuit of $421 million, did not receive a dime!
- Jury found Samsung infringement of Apple utility, design patents for some (though not all) products.
- Jury found willful infringement on five of six patents.
- Jury upheld Apple utility, design patents.
- Jury upheld Apple trade dress ‘983.
- Jury found Samsung “diluted” Apple’s registered iPhone, iPhone 3, and “Combination iPhone” trade dress on some products, not on others.
- Jury found no Apple infringement of Samsung utility patents.
- Jury found Samsung did not violate antitrust law by monopolizing markets related to the UMTS standard.
- Damages owed by Samsung: $1.05 billion.
At 2:35 PM U.S. Pacific Daylight Time, the jury informed the court that it had reached a verdict, which was read before District Judge Lucy H. Koh when all parties were assembled.
Apple, one of the most secretive of Silicon Valley companies, divulged seldom-seen levels of detail during the trial. Samsung, in revealing internal documents, showed the extent to which it copied Apple designs.
I personally find it gratifying that creativity and innovation are OCCASIONALLY rewarded in American business – in the case of Apple, it took FAR too many years before many customers “saw the light.” (Some, of course, remain in total darkness, still! 😉 ) When customers DID see the light, other companies were quick to reverse-engineer and to copy products outright.
